Wogblog posted an article on the possible upcoming release of ‘The Beatles Bootleg Recordings 1963 – Official Release along with a follow up article on the copyright aspect of it all. Examiner also posted about this as well as how the Beach Boys are also said to be following suit as are other artists. Additionally an NME article mja found on this which uses a Beatles spokesman as the source for its information.

Release date is said to be Tuesday 17th December. Nothing official has been forthcoming at the time of posting.

Thanks for getting this back up, mmm. Such an annoying situation for all.

Anyway, I want to comment on the NME article, I would suggest that that is official confirmation that this release will happen, just not that it will happen on 17 December.

To me, when somebody cites a “Beatles spokesperson”, they’re saying they’ve confirmed it with Apple.

Maybe but you often see newspapers and articles claiming a source says and everyone knows they made it up. I have little doubt NME did speak to an Apple spokesman but officially Apple have announced nothing.

Was reading on another forum and what some are saying is that everything and anything recorded in 1963 which is in the vaults and has not been issued in the last 50 years falls out of copyright on the 1st January 2014, therefore if Apple were to release it in 2014 then anyone is free to do so too. The source is an Allan Kozinn article (it’s behind a paywall so cant be linked to).

Going by that there is even less incentive for Apple to issue anything with outtakes of new stuff from 1963 post 2013.

Not entirely true. Were they to include, for instance, the raw studio tape of breakdown take 2 of Twist And Shout  on some future release, they could not claim copyright. However, they would not do that. It would go through some mixing/remastering process, and the copyright would be claimed on that.

Ok i don’t get this. So when do the actual official ’63 songs copyright run out as those arent the same as the 2009 remasters then. Do you have to hunt down those crappy compilations in the 70’s and early 80’s to figure that out as weren’t the 1987 songs remastered in some way as well? And will Apple have to at some point reissue the nonremastered tracks to keep the copyright of those.

Can’t they just make it all easier and say that song is that song regardless of mixing, remastering or anything else that happens years down the line?

Everything, including the remasters, only gets an additional 20 years. So, for example, the 1963 recordings are protected up until 2033. My example of take 2 of Twist And Shout , I used that as something that hasn’t seen the light of day. Were anyone to get hold of the raw tape then, after 11 February 2014, they could do what they wanted to with it. Any official release of it, no matter when released, would establish copyright on that “production”.

Another mistake that is being made is 31 December being a hard cut-off. It is a gradual unfolding. The copyright on something recorded on the 11 February 1963 does not run out at the same time as their finishing touches to With The Beatles  on 23 October 1963. Though, obviously, it is easier to handle a year at a time. But this could indicate a further 1963 volume, as most of the missing bootlegged material comes from the second half of the year.

The interesting one is the Yellow Submarine Songtrack  which they actually remixed. I would guess that those mixes have 70 years from date of release.

At its most basic, it’s like protecting a photograph. How you first print that photograph is protected from the day you do it. Come back to that print years later and clean (remaster) it, and it’s still the same photograph. Go back to the negative (Yellow Submarine Songtrack ) and decide to print a version using a yellow filter (remix), you’ve created a new print and can claim protection on that print.

It’s up and coming and, if you are in New Zealand it’s came already; The Beatles Bootleg Recordings 1963 will be here and there are upgrades. Wogblog writes 

From our readers over there we have so far got these comments: “Saturday Club Jan 26 Some Other Guy is an upgrade, Love Me Do  is complete and an upgrade. A Taste Of Honey Misery  and Do You Want To Know A Secret  outtakes are in STEREO! Money is undubbed. Bad To Me sounds much cleaner!”

 

There is nothing yet on the UK iTunes so i presume its just going to appear at some point on the day of release.

Examiner has also posted an article on the album becoming available in some countries around the world including Indonesia and Japan.

And this would seem to create another difference with the earlier Dylan release, in that he limited his physical release to distribution European markets. I don’t whether iTunes could have actually done that, but it does look as if it is slowly going to roll out across all their stores over the next few hours.

As a slight aside, but still concerning copyright, is the songwriter’s copyright. A writer’s copyright on their work runs out 70 years after their death. This means that the Lennon estate will stop receiving songwriter royalties in 2250, including on those songs credited Lennon/McCartney, whereas the McCartney estate will still be getting for the majority of the rest of this century, and depending on how long-lived Paul is, and he’s looking like he’s got at least a good couple of decades in him yet, probably into the next century.

Makes you wonder if, closer to that 2250 cut-off, moves might not be made to change that 70-year rule on multi-authored works to kicking in for all when the last writer passes. It does seem strange that, for instance, the McCartneys will continue to earn a writing royalty on Give Peace A Chance  for many decades more than the Lennons. It does also throw up the strange anomaly of, so far as the writing copyright goes, the Lennon/McCartney songs will spend a period when they are half in copyright, and half out.

I haven’t looked sorry – I don’t have iTunes on my computer (you may have read elsewhere how I just LOVE it sooooo much :)   ).  I’ll boot up my wife’s PC and have a look – she has an iphone so I think she uses it.  Back soon.

Thanks for that! That would seem to indicate that it’s doing something like a New Year’s Eve/New Year’s Day rollout, and that it’s going to be a worldwide release.

I’d grab it as quick as you can! It could turn out to be available for a very short time, and however long it is up for, it is 59 officially released tracks.
